These Terms of Service (“Terms”) govern your access to and use of this website and any communication with Malcolm Kingley, an individual, and Kingley Foundation, a faith-based organization registered in the State of Washington and organized as a 508(c)(1)(A) non-profit (together, “we,” “us,” or the “Ministry”). If you do not agree to these Terms, do not use this website and do not request prayer. You must be at least 18 years old to submit a request.
2. Nature of what is offered
The Ministry offers Christian Science prayer only, as a religious practice. The purpose of that prayer is a better understanding of God and man and of the relationship between them, which is understood to bring about scientific healing according to the Bible.
We do not provide medical, nursing, psychological, psychiatric, counseling, crisis, nutritional, legal, financial, or any other licensed or professional service, and nothing on this website may be construed as such. The Disclaimer is incorporated into these Terms by reference and forms part of this agreement.
3. No professional relationship; no reliance
Your use of this website and any prayer offered creates no physician-patient, therapist-client, attorney-client, fiduciary, employment, agency, partnership, or joint venture relationship. Content on this website is provided for general religious and informational purposes and is not advice on which you should rely for any personal, medical, legal, or financial decision.
4. Your responsibilities
- You are solely responsible for your own care and for all decisions you make about it.
- You will not rely on this website in an emergency; you will call 911 or your local emergency number.
- You will provide accurate information and will not submit requests on behalf of another person without lawful authority.
- You will not use this website unlawfully, to harass, to transmit malicious code, to scrape or harvest data, or to interfere with its operation.
- You will comply with all laws applicable to you, including any legal duty of care you owe to a minor or dependent.
5. Communications and fees
The contact form on this website opens your own email application; the Ministry does not operate a payment system on this website. Where a contribution or love offering is accepted, it is voluntary and is not a fee for a service, not a purchase, and not consideration for any promised result. Unless otherwise stated in writing, contributions are non-refundable.
Email, text, and telephone are not secure channels. Do not send information you consider sensitive. See the Privacy Policy.
6. No warranties
THIS WEBSITE AND ALL CONTENT AND PRAYER ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, UNINTERRUPTED AVAILABILITY, OR ANY WARRANTY OF RESULT, HEALING, CURE, OR OUTCOME.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER MALCOLM KINGLEY NOR KINGLEY FOUNDATION, NOR THEIR RESPECTIVE OFFICERS, DIRECTORS, TRUSTEES, VOLUNTEERS, EMPLOYEES, OR AGENTS, SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, ILLNESS, DEATH, EMOTIONAL DISTRESS, LOSS OF DATA, OR ECONOMIC LOSS, ARISING OUT OF OR RELATING TO THIS WEBSITE, ANY PRAYER OFFERED, ANY DECISION YOU MAKE OR DECLINE TO MAKE, OR ANY DELAY IN OR REFUSAL OF MEDICAL OR OTHER CARE, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE LIABILITY CANNOT BE EXCLUDED, THE TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU CONTRIBUTED IN THE PRECEDING TWELVE MONTHS, WHICHEVER IS GREATER.
8. Assumption of risk and release
You knowingly and voluntarily assume all risk associated with your own choice of care and, to the fullest extent permitted by law, release and forever discharge Malcolm Kingley and Kingley Foundation from any and all claims, demands, damages, and causes of action arising from or relating to that choice.
9. Indemnification
You agree to defend, indemnify, and hold harmless Malcolm Kingley and Kingley Foundation and their officers, directors, trustees, volunteers, and agents from and against any claim, liability, loss, damage, cost, or expense (including reasonable attorneys’ fees) arising out of your use of this website, your breach of these Terms, your violation of law, or any decision made by you or on behalf of any person for whom you are responsible.
10. Religious liberty
The activities described on this website are the free exercise of religion, protected by the First Amendment to the United States Constitution, the Washington State Constitution, and applicable religious-freedom statutes. Nothing here is intended to, and shall not be construed to, constitute the unlicensed practice of medicine or of any other regulated profession.
11. Intellectual property
All text, images, photographs, marks, and design elements on this website are owned by Malcolm Kingley or Kingley Foundation, or used with permission, and are protected by copyright and trademark law. You may view and print pages for personal, non-commercial use. Any other reproduction, distribution, adaptation, or commercial use requires prior written permission.

13. Governing law; venue; disputes
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. The parties will first attempt to resolve any dispute informally by written notice to the contact below and, failing that, by good-faith mediation. Any dispute not so resolved shall be brought exclusively in the state or federal courts located in the State of Washington, and you consent to personal jurisdiction and venue there. Each party waives any right to participate in a class, collective, or representative action. Any claim must be brought within one (1) year after it arises, to the extent permitted by law.
14. Changes, severability, entire agreement
We may modify these Terms at any time by posting a revised version with a new “last updated” date; continued use constitutes acceptance. If any provision is held unenforceable, it shall be limited or severed to the minimum extent necessary and the remainder shall remain in full force. Our failure to enforce any provision is not a waiver. These Terms, together with the Disclaimer and Privacy Policy, are the entire agreement between you and us regarding this website.
